I hope you will find the information here helpful. Let me stress that almost all of the information contained in these pages will work in any jurisdiction. NOT JUST UTAH.

However, when I became involved with the Utah family court system in 1996 there was one recurring issue that kept surfacing in almost every conversation I had with men in similar situations. The issue: Family Law Attorneys and if they were any good.

To understand the dubious nature of a Family Law Attorney you must first understand how Family Law proceedings are different than civil or criminal court proceedings. In Family Court, everything is based on the subjective decision of a Judge. Such decisions are loosely based on certain guidelines and laws usually associated with the "Best Interest of the Child". However much they throw that phrase around I have not witnessed many decisions that were "In the Best Interest of the Child".

Let me be very clear. A Family Law attorney will never be your "Knight in Shining Armor" that defends your honor before the court. They do little more than file paperwork and negotiate agreements, and they charge between $125.00 to $250.00 PER HOUR, for a "Service" that with a little knowledge, you could handle yourself.

I have run into a lot of Lawyers that are lazy if not incompetent, they only want to go through the motions of defending your rights. I was told by one Lawyer that "The court won't do anything about it anyway, so why bring it up". To get it in the court record that's why! And if that issue had been entered into the court record back then I don't think the court could have screwed me as bad in the long run.

I have also found that Family law attorneys are virtually useless in most family court cases. In fact they can (and often do) hurt your case more than help it. Unless you have significant legal issues such as jurisdiction problems, complicated community property issues or some other difficult legal issue, I do not believe you need an attorney.

I am not saying that all Lawyers are idiots, I am saying the good ones are the exception NOT the rule. And you would be better off doing it yourself than trusting it to the majority of Lawyers out there.

First off, don't presume that you need an attorney because of angry threats made by the opposing party or because you have been served with Family Law legal papers. Again, Research OTHER legal options. Family law issues are easier to resolve than you might think.

The truth is unless you take control of your own case and learn how the system works no attorney or other legal professional will ever help your case. A family law case stays open forever therefore you must commit to learning the steps you can take to win or, at least, improve your situation. Again you must take the time to learn the rules of the game before you play.

I have been involved in the Utah Family Court System for nearly 10 years now, and I started Utah Parents Under Siege in September of 2004 to offer self-help legal assistance to men who simply did not have the money to hire an attorney.

Many men hire family law attorneys in the beginning of their cases but they either run out of money or become frustrated with the lack of results and give up, when they should have decided to take control and do it for themselves. I am here to help you with the basics of filing court papers and arguing your case in front of the judge.
